Qui est concerné par l’accessibilité ERP ?

L’accessibilité concerne tous les Etablissements Recevant du Public (ERP), y compris les cabinets médicaux et centres de santé, quelles que soient leur taille et leur spécialité. La loi n°2005-102 du 11 févier 2005 stipule en effet que les ERP doivent être accessibles aux handicapés et aux PMR.
L’objectif est de permettre à toutes les personnes ayant un handicap moteur, visuel, auditif ou mental et à celles ayant une mobilité réduite (PMR) d’accéder à votre cabinet médical pour bénéficier de vos soins.
Les professionnels libéraux de santé dont la structure est installée dans un bâtiment existant peuvent demander une dérogation d’accessibilité sous certaines conditions :

Sanction en cas de non accessibilité du cabinet médical

Les cabinets médicaux et centres de santé qui ne respectent pas leurs obligations de mise en accessibilité pour les personnes handicapées et PMR peuvent écoper jusqu’à 45 000 € d’amende (225 000 € pour les personnes morales). En cas de récidive, le propriétaire des lieux encourt jusqu’à 6 mois d’emprisonnement.
